-
In Saint-Barthélemy and Saint-Martin, due to the calendar shift, the winter sales of 2026 will take place from May 2, 2026 to May 29, 2026, slightly before the summer sales for the metropolitan territory.
The dates for online sales or distance selling (e-commerce) are aligned with the national dates for traditional retail, regardless of the location of the company's headquarters.
Which products can be sold off?
Products on sale must have been offered for sale and paid for at least one month before the start of the sales. It is forbidden to procure stock specifically intended for the sales a few days before the start date of the commercial operation, without the products having been previously offered for sale.
In the store, the distinction between sale items and non-sale items must be clearly visible to consumers: precise labeling, separate location within the store, etc.
What prices during the sales?
The seller must clearly indicate discounts compared to a real reference price. It is therefore forbidden to increase the price of a product before the sales period, with the aim of creating the impression of a larger promotional offer than it actually is.
The retailer must be able to justify the reference prices of the sale items: either the lowest price actually charged before the start of the promotion, or the price recommended by the supplier or the head of the network.
Furthermore, it is forbidden not to apply the price reductions displayed in the window, a practice considered misleading advertising.
What advertising during the sales?
Under penalty of a fine of €1,500, any advertising related to a sales operation must mention:
-
the start date of the operation;
-
the nature of the goods on sale, if not all products in the establishment are concerned by the clearance.
The duration of each sales season is set at 4 weeks. The dates are set in accordance with the order of May 27, 2019 setting the dates and times of the start of sales and Article L. 310-3 of the Commercial Code.
