Influencers: New mandatory disclosures when promoting professional training courses Published on May 7, 2026 - Entreprendre Service Public / Directorate of Legal and Administrative Information (Prime Minister's Office)
A decree dated March 30, 2026 specifies the information that influencers are required to include when promoting training courses funded by public funds (such as the CPF, for example). These new provisions have been in effect since April 2, 2026.

To regulate commercial influencing and combat deceptive commercial practices, the "influencers" law of June 9, 2023 established a legal framework. It specifically states that the promotion of training courses funded by public funds must include several pieces of information. These details are set out in the decree of March 30, 2026.
Content promoting such training courses must now include:

a statement indicating that the professional training is publicly funded, noting any commitments involved and eligibility rules;

depending on the medium, either a hyperlink to the applicable regulations, a reference to the website hosting this information, or an informational message.
These elements must be presented "in a readable or audible manner, as appropriate for the medium, clearly distinguishable from the promotional message and any other mandatory disclosures."
For videos (or static images), the mandatory disclosures must appear for at least 90% of the duration of the promotional content. A dedicated area on the screen must be reserved for this purpose. This area must be horizontal and occupy 7% of the advertising space.
If the promotion is broadcast via radio or offered as on-demand audio, these elements must be stated immediately after the promotional message.
Failure to comply with these obligations may result in a penalty of one year's imprisonment and a fine of €4,500.
An order will further specify:
