Purpose
These Terms of Use govern access to and use of Pionra, a community platform for foreign nationals living in France or preparing to move to France.
The platform is published and operated by SMART GADGET HOME SARL (SIREN 814 564 407), a SARL registered with the Trade and Companies Register under Paris 814 564 407, with its registered office at 73 rue de l'Évangile (Centre 189 rue d'Aubervilliers, 9 voie A), 75018 Paris, France.
Pionra allows users to publish experiences, questions, listings, guides and community content by country, city, language or category.
Acceptance
Some website features may be freely accessible, but creating an account or using interactive services requires full and unconditional acceptance of these Terms of Use.
By creating an account, users acknowledge having read, understood and accepted the Terms of Use and the current Privacy Policy.
Eligibility
To use Pionra, users declare that they:
- are at least 15 years old;
- reside in France, intend to reside there or have a legitimate interest related to France;
- provide accurate, current information;
- have not been permanently suspended unless Pionra has lifted that suspension.
User account
Users are responsible for keeping their credentials confidential, securing their password and all actions carried out through their account.
- An account must correspond to a single identified individual or legal entity.
- Profile information must remain truthful and must not mislead.
- Users must inform Pionra without delay of any unauthorised access.
User content
Users retain ownership of content they publish on Pionra, subject to the rights granted below to allow normal operation of the service.
By publishing content, users grant Pionra a non-exclusive, worldwide, royalty-free licence, transferable to technical subcontractors, to host, reproduce, adapt to technical formats, display and distribute that content on the platform and its service-related communication channels.
Rules of conduct
Users must not publish or relay, in particular:
- discriminatory, hateful, defamatory or harassing content;
- illegal, fraudulent or misleading content or content encouraging circumvention of the law;
- spam, mass solicitation or unauthorised promotional content;
- nudity, sexually explicit or violent content outside the legal framework;
- infringements of copyright, privacy or image rights;
- content impersonating a third party or misleading the community.
- Any form of child sexual exploitation or abuse is strictly prohibited; such content is removed, its authors banned and reported to the authorities (see Child safety).
Moderation
Zero tolerance: objectionable or illegal content and abusive behaviour have no place on Pionra. You can report content and block users. We remove the content concerned and may suspend or close the accounts responsible.
Pionra may moderate, unpublish, restrict, delist or remove any content manifestly contrary to the law, these Terms of Use or the safety of the community.
Reports are handled within a target of 24 hours for urgent or manifestly illegal cases, in accordance with the moderation arrangements established to meet Digital Services Act requirements.
Reporting
Any user may report content or behaviour using the tools available on the platform. Reports must be made in good faith and be sufficiently precise to allow the case to be examined.
Abuse of reporting, particularly to have lawful content removed or to harm another member, may itself lead to moderation.
Suspension / Deletion
Pionra may temporarily suspend or permanently delete an account for a breach of the Terms of Use, fraud, harm to service security, failure to comply with moderation decisions or a legal obligation.
Unless legally prohibited, Pionra endeavours to inform users of the action taken and its main reason.
Intellectual property
The website, its structure, features, brands, distinctive signs, design and editorial content belong to Pionra or its rights holders. Any unauthorised use is prohibited.
User content remains its authors’ property, but the licence described in “User content” is necessary to allow its distribution on the platform.
Limitation of liability
Pionra acts as a hosting provider and community platform operator. As such, Pionra does not guarantee the truthfulness, quality or inherent lawfulness of all content published by users before any moderation.
Pionra cannot be held liable for indirect damage, loss of opportunity, data or revenue resulting from use of, or inability to use, the service, unless mandatory law provides otherwise.
Applicable law
These Terms of Use are governed by French law, subject to any more protective mandatory provisions applicable to consumers.
Jurisdiction
For disputes not resolved amicably, express jurisdiction is granted to the courts of Paris, subject to mandatory rules applicable to consumers.
