Tenants in Difficulty

Rent Arrears: Social Support Triggered Earlier to Prevent Evictions Published on August 12, 2026 - Service Public / Direction of Legal and Administrative Information (Prime Minister)

If you are having difficulty paying your rent, you can now be supported earlier in your process to avoid an eviction. A decree published in the Official Journal on August 6, 2026 specifies the new modalities for the social and financial diagnosis, a document that allows the assessment of the situation of tenants in arrears and the orientation of their support.

Social and Financial Diagnosis Conducted Earlier

To identify difficulties more quickly and to facilitate the implementation of adapted solutions (debt restructuring, financial aid, etc.), the social and financial diagnosis is now conducted earlier to prevent an eviction.

Until now, the social and financial diagnosis was conducted when the tenant was summoned before the judge in the context of a termination of the lease for rent arrears.

Now, when your landlord is an individual or a family SCI, the social and financial diagnosis is conducted as early as the stage of the payment order and not only during the judicial procedure.

The representative of the State in the department (prefect) can request the realization or updating of a diagnosis before taking a decision concerning the assistance of the public force in the context of an eviction.

An Update of Your Situation Before the Hearing

If, one month before the hearing, no social and financial diagnosis less than six weeks old has been established, a new interview is proposed to you to carry out or update the diagnosis. This update allows to take into account any situations of vulnerability that you may encounter and the steps taken to maintain you in the accommodation.

The decree provides that the social and financial diagnosis be transmitted to the CCAPEX as soon as it is completed, and then at each subsequent update. This transmission aims to strengthen the monitoring of arrears situations and the coordination of eviction prevention measures.

When the tenant does not participate in the interview, the professional in charge of the diagnosis can now carry it out based on the information available to them and that transmitted by the coordination commission for eviction prevention actions (CCAPEX). This commission can also request the realization or updating of a diagnosis to examine the situation of a tenant in difficulty.

The CCAPEX is a departmental body that coordinates eviction prevention actions and guides households in difficulty towards aid mechanisms (FSL, social support, etc.).
