The Payment Order Procedure is Changing Published on September 4, 2026 - Entreprendre Service Public / Direction of Legal and Administrative Information (Prime Minister)
The reform of the payment order procedure came into effect on September 1, 2026. We provide details on the main changes.

The Decree No. 2026-96 of February 16, 2026 modifies the payment order procedure as follows:

The creditor now has a 3-month period (instead of 6 months) to have the payment order order served by a justice commissioner to the debtor.

The creditor no longer needs to request a certificate of non-opposition from the debtor at the court registry for the order to become an enforceable title. The court registry of the judicial court now transmits the debtor's opposition notice by registered mail with acknowledgment of receipt or electronically within one month of receipt. As a reminder, in commercial matters, in case of debtor opposition, the court registry of the commercial court informs the creditor and asks them to deposit the opposition fees.

The order becomes an enforceable title at the expiration of a 2-month period following its service if the creditor has not received an opposition notice or an invitation to deposit the opposition fees.
This reform applies to payment orders rendered from September 1, 2026.
